1. About SiteCobba
SiteCobba is a software assistance tool for builders, tradespeople and small construction businesses. It uses artificial intelligence, voice input, photo analysis and reference data to assist with admin tasks including voice-generated quotes, AI-generated site reports, timesheets, yard inventory, voice calendar scheduling, rate libraries, PDF exports, offline syncing, team accounts and merchant pricing references.
SiteCobba is a software tool only. SiteCobba does not provide, and must not be relied upon as, professional quantity surveying, structural or civil engineering, architectural, accounting, payroll, tax, legal, building certification, building consent or construction advice. We are not a licensed building practitioner, registered surveyor, accountant or legal advisor.
2. Eligibility & Accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for maintaining the security of your account and any activity under it.
- Information you provide on signup must be accurate and kept up to date.
- Team/company accounts: the account owner is responsible for the conduct of all invited users.
3. Free Trial & Guest Access
SiteCobba may offer a free trial period (currently 14 days) without requiring a full account. Trial data is stored on your device and synced when you create an account. We may modify, limit or discontinue trial access at any time without notice.
4. AI-Generated Outputs — Drafts Only
All quotes, reports, summaries, schedules, calendar events, inventory entries, pricing suggestions and other outputs generated by SiteCobba's AI features are drafts only. They are starting points to assist your work — not finished professional deliverables.
You are solely responsible for independently reviewing and verifying every output before relying on it, including:
- pricing and unit costs;
- labour estimates and time allowances;
- GST and other tax calculations;
- measurements, dimensions and quantities;
- compliance references including the New Zealand Building Code, NZS 3604, the National Construction Code (NCC), AS 1684 and any other standards;
- schedules, programmes and milestones;
- timesheets, payroll figures and invoices;
- site reports, safety notes and next steps; and
- any other figure, statement or recommendation produced by the platform.
AI outputs may contain errors, omissions, fabrications ("hallucinations"), outdated information or incorrect references. You must apply your own professional judgement and, where appropriate, obtain independent advice from a qualified professional before acting on any output.
5. Merchant Pricing References
SiteCobba may display indicative pricing or product references for builders' merchants including but not limited to Bunnings, Mitre 10, ITM, Carters, PlaceMakers and Reece. SiteCobba is not affiliated with, endorsed by or sponsored by any of these merchants. Prices shown are estimates only — they may be delayed, regional, out of date, rounded or inaccurate. You must confirm current pricing and availability directly with the merchant before quoting or purchasing.
6. Your Responsibilities
- You will use SiteCobba lawfully and only for legitimate business purposes.
- You will not upload content you do not have rights to, or content that is unlawful, infringing, harmful or misleading.
- You will independently verify every AI-generated output before sending it to a client, lodging it with an authority or relying on it commercially.
- You will keep your own backups of any business-critical records. SiteCobba is not a record-of-truth or document of record system.
- You will not attempt to reverse engineer, scrape, resell, sublicense or use the service to build a competing product.
7. Service Availability — "As Is" / "As Available"
SiteCobba is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we exclude all warranties, conditions and representations, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, reliability, uninterrupted access, error-free operation, security, or non-infringement.
We may add, change, suspend, throttle or remove features at any time without notice. Offline syncing, push notifications, calendar reminders and background processing are best-effort and are not guaranteed to deliver, sync or fire on time.
8. Limitation of Liability
To the maximum extent permitted by law, neither SiteCobba, its parent, owners, directors, employees, contractors, suppliers nor affiliates will be liable to you or any third party for any loss, damage, claim, cost or expense (whether direct, indirect, incidental, special, consequential, punitive or exemplary) arising from or connected with your use of the service, including without limitation:
- underquoting or overquoting on any project;
- incorrect measurements, materials, labour or compliance references;
- project losses, delays, rework, variations or disputes with clients or subcontractors;
- payroll, PAYE, superannuation/KiwiSaver, GST or other tax errors;
- contract disputes or regulatory action;
- data loss, data corruption, sync failures, downtime or service interruptions;
- missed reminders, missed appointments or missed deadlines;
- lost profits, lost revenue, lost opportunity, lost goodwill or business interruption; and
- any indirect or consequential damages of any kind.
Liability cap. Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising in any 12-month period is capped at the total subscription fees actually paid by you to SiteCobba in the 12 months immediately preceding the event giving rise to the claim, or NZ$100, whichever is greater.
Consumer law. Nothing in these Terms limits any rights you may have that cannot lawfully be limited or excluded under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable consumer protection legislation. Where SiteCobba is acquired for business purposes, the parties agree to contract out of those Acts to the maximum extent permitted.
9. Indemnity
You agree to indemnify, defend and hold harmless SiteCobba, its owners, directors, employees, contractors, suppliers and affiliates from and against any and all claims, demands, liabilities, losses, damages, fines, penalties, costs and expenses (including reasonable legal fees on a solicitor-client basis) arising from or related to: (a) your use of the service; (b) any content you upload or generate; (c) your reliance on any AI-generated output; (d) any breach of these Terms; or (e) any breach by you of any law or third-party right.
10. Suspension & Termination
We may suspend, restrict or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, misused the service, failed to pay, or if continued provision of the service to you creates a legal, security or commercial risk to us or other users.
You may stop using SiteCobba at any time. Termination does not entitle you to a refund except as required by law.
11. Intellectual Property
SiteCobba, its software, branding and content are owned by us or our licensors. You retain ownership of content you upload, but grant us a worldwide, royalty-free licence to host, store, process, transmit and display that content as reasonably required to operate, secure and improve the service.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of SiteCobba after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New Zealand (with Australian consumers protected under Australian Consumer Law where applicable). The parties submit to the exclusive jurisdiction of the courts of New Zealand, except where mandatory consumer law in your country of residence requires otherwise.
